American officials aren't lifting the ban on F-22 exports to Japan (despite the clear benefits of doing so) precisely because they are afraid that the Japanese will (inadvertently) pass on F-22 technology.
As for the Japanese Constitution question, I was pretty sure the 1% figure is an aspect of Article 9. Upon review, it isn't, so mea culpa. OTOH, I do know that Japan has consistently NOT spent above 1% of total GDP on the military, and that at least the reason for that is certain terminology in Article 9
That's not the reason, you ignorant ****. The 1% of GDP policy is not mentioned in the constitution, is not legally binding in any fashion, was only begun in 1976 and was violated for the first time a mere 11 years later.

It isn't smart for Japan, politically speaking, to go above that amount, given that AFAIK, they usually don't. How many years since 1976 has Japan gone above that 1% mark? And what were the political consequences, domestically and regionally?

Japan has an annual military budget of nearly $50 billion and they don't need to budget for the aircraft carriers, nuclear subs, nuclear missiles and other big ticket items that peers like Britain and France do. There is plenty of money available for the Japanese to procure the relatively modest amount of F-22s (40 to 60) they require while keeping military spending at 1% of GDP. Even if they decide to go a bit over for some reason, it won't be a big deal. They've done it before and the public won't be concerned about a replacement for the F-15 in the way they would be if Japan was acquiring a more overtly offensive weapons system
