Especially the supreme court. Which is why it probably took so long. I'm sure it was appealed originally.

I'm still trying to figure out how the judge could hold the state of NSW responsible for this.
          Presumably, this part:
Repeated complaints to staff were ignored, he said.
I'm pretty sympathetic to people who get bullied. I remember those times. But damn, yo.

Gee back when I was in school, complaints to the staff usually resulted in additional abuse.
So this kid probably brought it on himself.

Did you steal his money and banish him from the sandbox?

I'm not an a complete arsehole. I just teased him for looking exactly like Steve Urkel, except fatter. I feel bad about it now. At one point, I tried searching Facebook for his name to offer an apology. Couldn't find him though.

Sounds like you weren't much of a bully.

Justice Elizabeth Fullerton today handed down a 112-page judgment
Good God, how can anybody write 112 pages on such BS? Even double spaced legal style...

The appeals judge should just respond "tldr" and overturn it.

The limitation period is 3 years but it's waivable in certain cases. If the plaintiff can show he wasn't aware of either the fact that his mental injuries were caused by the bullying (and in turn the school's failure to stop that bullying). It's also waivable if the plaintiff can show that he wasn't aware of the extent to which this the bullying (and the school's failure to stop it) caused his mental injuries. However, the plaintiff also has to show that, once he became aware of the fact that the defendant's negligence caused his injuries (and the extent to which this was so), he instituted proceedings in court within 3 years of that time.

It's the "extent to which the injury was caused by the defendant" part that looks like it could be very advantageous to plaintiffs. I'm guessing it's what the plaintiff relied on here.

Parents everywhere should now encourage their kids to be bullied -- sort of a nice retirement plan.
The state of NSW is liable because this concerned the failure of a NSW public school to prevent bullying.

Secondly, I don't think every person bullied here can say that school bullying caused him to experience mental illness.

From Grade 6 to Grade 7 I beat up an effeminate red haired boy who sang in the choir almost every single day for two years. He had an oddly high-pitched voice and girly-eyes.

We made peace in Grade 8 when I could no longer consistently knock him down and we discovered a mutual interest in cheap red wine and really sleazy porn.

Wooded areas. Those silly gazebos they put in mcmansion suburbs. I guess I'm sorry. I had a lot of stress at the time though and the guy was really annoying. I think he secretly got a masochistic charge out of it though.

We later 'co-captained' the Grade 8 Track & Field Day!

                                Good times.
