And the EPA recently announced that it will regulate carbon emissions from power plants. Not the ideal situation, but it's all that the Admin can do absent action from Congress.

The Bush Admin said the same thing. The question was always "what constitutes torture?", not "is torture legal?".

Waterboarding is hardly the only practice in question, and the Bush Admin never claimed that the practice was illegal. The key point is that interrogations are now bounded by the army field manual.

On waterboarding, in which a person gets the sensation of drowning, the memo said, "although the waterboard constitutes a threat of imminent death, prolonged mental harm must nonetheless result" to violate the law.

so if these guys complain about their lack of mental health in a few years thanks to all this non-torture, does it mean they were tortured?
