Those are crimes committed within the legal jurisdiction of USA. I have no problem with trials where a valid law is broken, thats why I support sending em back to Afghanistan or Iraq - to face trial.
Actually that reminds me of the April 2001 Hainan Spy Plane incident where a US spy plane was taken by the Chinese. Various intriguing legal arguments went into the ether during that time.

Yes. It is pretty much impossible for someone to still have any intelligence value over 6 years after they were captured. What could they possibly know that wouldn't be far too dated to be useful?

But the proper thing is to try them in a court of law. What, you think that a US jury is likely to go easy on a suspected Islamist terrorist?
I think one concern was that our rules for discovery would endanger sources of intelligence. The government could just claim some sort of national security privilege to protect them, but then it's not really a fair trial.
These sorts of things are never as simple as you might think.
