        Right, Donegeal is more versed than me by virtue of age.

        Me-attorney who spent most of my (still young) career dealing every day with prosecutors, judges, criminals (alleged and convicted) victims, defense attorneys.

                  They've had almost 20 years to raise this issue on appeal, you have to wonder why they waited until the very last moment to do so.

                  Meritless stalling tactics? Nah.. that couldn't be, never heard of that in death penalty cases.

                  As always, my compassion is with the murder victims and their kin, not the guy who gets all the press just before he croaks it.

                    I'm curious what sort of punishment the former judge and prosecutor might face as a result of this if any. Since they are no longer at their jobs are they pretty much off the hook?

                        I'm sure the strategy of the defendant was to sit in prison for 19 years before trying to get a retrial.

                          I am overwhelmed by the defenses incredible ability to dig up details of an affair 19 years after it happened. I am also amazed at the ability of the participants in said affair to have kept it secret that long only to let it slip here at the 11th hour.

                                So it turns out that yes, the judge and the prosecutor were having an affair, though neither would admit that it continued through the trial they both admitted to traveling together after the trial occurred, so I'm guessing they were less than truthful on the end date.

                                say what you want about the late timing, but there's no way you can execute a man who was convicted under these circumstances.
