      Technically the guy could be executed since that is still on the books here but the last time we did that was in 1945. Probably going to get 18 months in prison. Too bad they won't make him payback his training costs and any benefits might have recieved.

        Dino - If he did face execution there may have been a different decision in his case. The fact that it is on the books but not used is important.

          I know a guy who did 25 years for selling cocaine.

            I think the precedents have been much shorter terms Sloww. The 18 months mentioned earlier seems more likely from the cases that have already gone forward.

              Well it remains the maximum penalty for desertion in wartime. But like I said, the last time anyone was executed for it was 1945.

              Sloww: The max penalty I've heard of recently for this crime is 18 months in a military prison. He might get a little more for being a pain in the ass but 25 years likely isn't gonna happen.

                Out of curiosity, do you guts know what did Canada do with deserters in pevious wars?
                I found one Link which says that, following the Vietnam War, 5,500+ U.S.deserters returned to the U.S. from Canada following the pardon by Ford.

                            Unfortunately, no; this is one of the significant points of contention I have with the prosecution of the Afghan and Iraq war. The national guard is certainly put forward as what you say, but it is full scale military like anything else, when activated.

                            I'd prefer the NG to be kept separate from the Reserves, in that the Reserves may be called up to serve overseas, and the NG only be used domestically, no matter what. If that were the case, I'd sign up for the Guard (as I had been considering for years); but not if there's a snowball's chance in hell of being deployed overseas.

                              If that was the case I would strip the NG of all their equipment and cut it in half, giving the billets to the Reserves.

                                I think the specific details like that would be addressed as needed... I suspect (given Katrina, for example) the NG needs as much as it has or more just for local issues. But it's quite possible the specific equipment should change; certainly relatively few tanks should be needed for example However, cargo planes and helicopters are a different matter, and they may well need more of those...

                                I'd like the NG to be the disaster aversion force and 'last defense against invasion', rather than a mini-army. That's what the reserves are for, and what they should be used for.
