  • Scalia is a piece of crap.

    I'm happy he is willing to go out into public to talk about his views as it gives everyone a chance to see what scum he is. Here's a recent interview 60 minutes did where Justice Scalia justifies torturing suspects and claims that "torture isn't a punishment" and so therefor torturing people doesn't violate the Constitution's prohibition against cruel or unusual punishment. I especially hate his stupid self satisfied grin at the end of the interview.

    His so obviously partisan in everything he does (just look at the Gore vs Bush case in 2000) and Scalia is so willing to go to any lengths of twisting and contorting in order to help out his political friends. It's disgusting.

      Yeah, what a nutjob! Obviously, nine appointed-for-life lawyers should write our laws and re-write the constitution at will. Actually, why bother with the constitution? It's redundant in the face of the god-like wisdom of modern jurists.
      We need seperate human-only games for MP/PBEM that dont include the over-simplifications required to have a good AI

        Uh... me thinks Oerdin doesn't actually really know Scalia's views. Let's check out the dissenting opinion in Hamdi v. Rumsfeld first of all.

          Yeah, I hate it when laws are enforced correctly. You realize this comment is funny given you are trying to paint someone else as partisain with it, right?

            It's worth bearing in mind that it works against him too. He's been downright savage to O'Connor and Souter in previous opinions, and I'm sure that lack of diplomatic tact, coupled with his utter disinterest in building any sort of consensus, has come back to bite him more than once. Even if he's the darling of conservatives, the man will never make Chief Justice because he's simply too polarizing.

            Heck, they even decided to promote Roberts to CJ before him!

              I have to say that Scalia's opinions make for the most interesting reads especially if he's dissenting.

                  Whenever I know he's in the dissent, that makes it much more likely that I'll actually read it. Some of the language he uses is a welcome change from the formal dull boring SCOTUS legalese.

                      I know he claims to be an original textualist who wants to try to figure out what the original founders wanted etc...

                      My point in what you quoted is that Scalia has a track record of sometimes being extremely partisan. That doesn't mean every case he's taken is identical but his actions in the 2000 gore/bush case were slimmy as can be.

                        You do realize that many Republicans take the view that justices like Ginsberg are extremely partisan too, right? It doesn't necessarily help matters in Bush v. Gore that the vote was 7-2 in regards to equal protection issues, but 5-4 in the remedy.

                          The problem with Scalia is that he is against a living constitution. Apparently he thinks we should instead adopt a new one every fifty years as happens in other countries with inflexible constitutions.

                              It's too difficult to get changes through that way. We'd still have segregation if we had to use the Amendment process.
