    BERLIN — Germany's highest court has upheld a law that makes incest a criminal offense, rejecting an appeal by a man who was sentenced to prison after fathering four children with his sister.

    The Federal Constitutional Court said Thursday it has ruled that the state is within its rights to cite "the protection of family order against the damaging effects of incest ... and the avoidance of serious genetic illnesses" in outlawing incest.

    The ruling followed a complaint by a 31-year-old man from eastern Germany, who has been identified only as Patrick S. He received a 2 1/2 year prison sentence for incest in 2005 but has been free pending the supreme court ruling.

    His sister, Susan K., who is now in her early 20s, was placed under the supervision of social services.

    The man had been given up for adoption at age 4 and met his birth-mother for the first time in 2000, at which point he also first met his sister. He and his sister then had four children.

    The man's lawyer has argued that there is no reason why two people who love each other should not be allowed to live together _ purely because they are siblings.

    However, the constitutional court ruled that sexual relations between siblings "do not affect them exclusively, but also can have an effect on family and society, and have consequences for children who arise from the relationship."

    The court said one of the judges who considered the case dissented in the Feb. 26 ruling, arguing that the ban was disproportionate.


    Incest is not outlawed in many countries anymore, on the other hand there are still severe resentments against it. What's Apolyton's take on it (i.e. the ultimate nerd's wisdom), is incest a tolerable behavior, a criminal offense, or perhaps the hang for it even a mental sickness?

    the constitutional court was right in its reasoning that such a relationship is not without "no effect for the rest of the world" as the children are likely to have genetic defects, but the sentence is wrong - ie too harsh, jail is inappropriate sentence for this type of social "wrongdoing" ...

    I would say that forced separation should have been enough to discourage this on the state level...

    in practical terms the couple could just move out of Europe later if they wanted the relationship above all else... but in principle the gov is right to be against this one, even though the sentence is way too harsh...

        should the law mandate the entire population be genetically tested to ensure compatibility and then dictate that you can only procreate with people who you are likely to have healthy offspring with?

        if not, then this is just a matter of cultural taboo and should not be a matter of law...

        as for my opinion?

        i'm not comfortable with the state mandating who i can do

        i also would never do my sister

        this doesn't happen often enough to cause significant problems to the global gene pool

        quite frankly, anyone worried about a such a thing is probably a nazi

          I think the major problem is that you have a very significant (far beyond that in normal relationships) of emotional abuse, or more specifically an older brother misusing his sister's emotional tie to him to emotionally coerce her into sexual relations with him. Add that to the fact that it is VERY risky genetically (and if it became common, it would indeed be very, very bad for the global gene pool) - but not just for the global pool, but also for their children, who have a much higher risk of genetic defect themselves - and I see no reason to permit it.

            This is untrue. Children are more likely to have recessive traits expressed, which may include health defects, but they are not likely to have them. It takes generations of inbreeding for such traits to express themselves regularly. The Habsburgs didn't go to pot all at once. Frankly, improper nourishment during pregnancy is far more likely to result in birth defects than incest, and we don't require women to take folic acid supplements, etc.

                There are a nontrivial number of genetic traits for which people often have a single recessive but not a second (or have 2 out of 4, etc.), where it is very likely for two siblings to end up with a child with 2/2 or 4/4. For example, I'm a carrier (2/4, probably) of alpha thalassemia, and if I were to procreate with my sister it's not unlikely that a child could be born 3/4 (very bad) or 4/4 (miscarriage).

                  I'd generally agree with this, except for cases where (emotional) abuse is a factor. That is a significant factor in many incest cases, and is probably why jail time is a possibility. In this particular case it seems odd, though the significant age difference may well be relevant. More than likely you don't know all of the circumstances for the case at hand
