      So Patroklos is right. The Public Defender didn't tell the judge to rule against his client... it simply wasn't a valid motion to make.
      It was an oral motion so it was possibly not valid for a number of reasons, least of which being the contents. The procedure isn't what Mr. Hafer was seeing, it was the intent and the intent seems clear from:

      Hafer had obviously asked for a new PD b/c he doesn't trust this one. Crickmer then begin giving reason why the Judge should not entertain such an oral motion. He was clearly asking the judge to rule against his client.

        It wouldn't have been a ruling as it wasn't an actual motion . It'd probably be more accurate to say the attorney was informing the judge as to why the argument should be not be entertained.

        Besides I doubt its the judge's call to make anyway (the state is defending the defendant, not the particular attorney).

          Stop looking at the procedure from your POV and look at it from Hafer's.

            Well, if you are going to be all smug and use the term 'ruling', at least use it properly, procedurally speaking, of course .

              1st prove to me the motion wasn't properly before the court then.

              Crickmer obviously had some concern else he would have STFU. The last thing you do in a courtroom is argue an issue that doesn't need arguing.

                I've been in this situation before, numerous times actually.

                I've never been punched, probably not even close while in court, but out of court, yeah, I've avoided getting punched probably very narrowly. I did have a friend who nearly got hammered in court by a massive guy, narrowly saved by the bailiff-hilarious.

                Unfortunately, when you're dealing with someone who is clearly a bit touched....they don't respond kindly to a realistic interpretation of the case. All lawyers have different ways of dealing with this situation, but apparently what this guy did, didn't work with his client.

                I basically tell my clients that I don't care what they decide to do, I'm here either way, and frankly my life is much more enjoyable going to trials, jury or bench, than just pleading people out. Its after all, why I chose to be a defense attorney rather than a paper pusher attorney (who gets paid a hell of a lot more than me).

                And yeah, I've stated on record that if the defendant wants another attorney, he can hire one, or he can represent himself, because there's no one else that's going to do it.

                Believe it or not, a lot of guilty defendants will do anything to try to get out of their penalty, including stuff like this! As an attorney, you have to respond to these allegations in court, otherwise you are possibly looking at an ineffective assistance claim being raised, or even a bar complaint.
