  • Something almost all of us can smile about

GEORGETOWN, Ky. (AP) — A public defender who was punched in court by a disgruntled client said Thursday he doesn’t blame the man who gave him with two black eyes.

The disorder in the court, captured on video, happened Monday at Scott County Circuit Court after the judge refused defendant Peter Hafer’s request for a new attorney.

Hafer, 30, of Cynthiana, told the judge he didn’t trust his court-appointed lawyer, Doug Crickmer. As Crickmer began to tell Judge Rob Johnson that Hafer couldn’t choose his public defender, Hafer landed the first punch.

“I just couldn’t take it anymore and I just snapped,” Hafer said later at the Scott County jail.

Hafer hit the attorney several times in the face and stomach. Hafer was restrained on the ground. Crickmer was admitted to Georgetown Community Hospital and released later that day. He said he will not file assault charges.

“I certainly don’t fault him or blame him or wish him any ill will,” Crickmer said Thursday on NBC’s “Today” show. “I think Mr. Hafer was just frustrated. Like I said, he had been in jail for some time. ... I think he just got frustrated, fed up, and he just snapped and I was the nearest target.”

Hafer was arrested in August on charges of burglarizing a K-Mart store in June.

As for his request for a new attorney, Hafer apparently will get his way. Authorities said a new one will be appointed.

Well, I did say "almost all". I expected a few oddballs like you to show up.

          1) Defendant tells judge he doesn't trust his lawyer.
          2) Lawyer begins telling judge to rule against his own client.
          3) Defendant punches lawyer.

          I love it.

I saw a defendant get pepper sprayed last week.

Unfortunately there weren't any lawyers in the immediate area.

Years ago in L.A., a criminal defendant told the court he was having a problem with his public defender.

The judge asked the attorney if there was a problem.

The PD said, "No, Your Honor. No problem."

The defendant then punched the PD.

The PD picked himself up and said, "Now we have a problem."

The judge ruled that the defendant should get another PD.

And word swept through the jails that, "If you want another PD, just punch the one you have." The number of jailhouse assaults skyrocketed.

Yeah, I can understand the desire/need to not have defendants fire their publicly paid for reps at a whim but if (like in this case) a defendant claims they don't trust their attorney, at the very least the attorney should STFU.

According to the OP, this didn't happen

Was the case about whether or not you not liking your public defender can replace him?

"The case"? The OP doesn't specifically say what Mr. Hafer was charged with. If forced to guess I would go with assault.

If you are asking was that Mr. Hafer's position (ie he didn't like his PD)... Not exactly. "Trust" was the issue he was trying to go with.

So Patroklos is right. The Public Defender didn't tell the judge to rule against his client... it simply wasn't a valid motion to make.
