    Since when do people get rights to a castle anyway? I'm willing to bet she didn't get the idea for Hogwarts totally on her own. I'm sure she used architecture from real life castles. Too bad the builders aren't around to sue her.

      IIRC, the damages for copyright infringment is the loss of all profits. From the way the ariticle is written, it sounds as if there will be no profits from this castle, so even if Rowlings wins, she will get 0.

        I think she should settle for an apology and a promise that in the future they will ask for permission.

        What about all the kids who in past years have dyed their hair black, painted a scar on their forehead, and worn an old pair of glasses for Halloween? Shouldn't she get a share of their Halloween spoils?

              Unless India has gone complete away from the English common law system, this makes no sense. "Fines" are obtained by the government because of legal infractions (speeding, polluting, etc.) "Damages" are awarded in a civil action. And it's only under the most rare circumstance you may sue on behalf of someone else. If I run over you in my car, your neighbor doesn't get to sue me on your behalf--you are the one that has to sue me.

                The relationship between publisher and author is not at all like car owner and neighbor. The publisher has purchased or negotiated rights to print and distribute the works from the author and is frequently a co-holder of certain rights.

                  Or unless the AP is using a fine in the common sense of the word, rather than as a technical legal term?
