    I hate threads like this. "Mr X sues Y for a silly reason." OMFG STOP THE PRESSES, THIS IS HIROSHIMA ALL OVER AGAIN!

    Get over yourselves. The only difference between this man suing some company for no reason and me banging my girlfriend is that suing a company costs a few thousand in lawyer fees. Well, guess what I can get a hooker for a few grand too. Not silly enough for a news story, you say? I can dress her up like Ronald McDonald and put it on youtube....Now THAT IS NEWS! Maybe it will get even more interesting if she SUES ME! I'd lose it in my pants!

    Dis, be ashamed of yourself. I wouldn't put cheese on my 6 inch roast beef sub at Subway, self restraint Putting cheese on a hamburger is like putting icing on the bullet that you use to blow your own head off.

        But she was right. Unfortunately McD's didn't have to pay the million $ fee, because it was reduced to a few hundred thousand. But I think they did reduce the excessive heat to the industry standard afterwards, so at least that helped.
        If I remember right, they paid 13 -15 Mill. You think that ladie still has a hot ?

          She boiled her nether region...McD's had had problems with coffee too hot before...

          ...but if you put your hot flimsy coffee cup between your legs you ought to get what's coming to you and I'm not talking $$$.

            The claim for punitive damages will be thrown out. There's no indication here of malice.

            The claims of the two people who rushed the burger eater to the hospital will be thrown out. McDonald's conduct was not aimed at them.

            If the case goes to trial, the burger eater willl get, at most, his $700 medical bills + an award for pain and suffering of, say, about $2,100. That's $2,800.

            The attorney will take 40% or $1,120. Say he "hotdogs" the case and spends only about 20 hours on it -- that's $50.00/hour.

            This leaves the burger eater with $1,680. If there's some depositions in this case (burger eater, two friends, McD people, and doctor), these expenses will eat up his award, and he might end up owning his attorney.

            I don't know what the going rate for defense attorneys is there, but say it's $200/hr. A defense attorney will spend at least 50 hours on the case; so, he'll collect $10,000.

                    Not even close. On appeal the punitive damage judgment was reduced to $480,000 (the compensatory damage judgment of $160,000 was kept in place). Then the two entered into a settlement agreement. No way if the last ruling was less than $750,000 would McD's accept a $13mil settlement.

                                The Defense Bar goes screaming to the media with stories like the McDonald's coffee case, so it can argue to the Legislature that we need "caps" are part of "tort reform."

                                But they don't get tort reform. Rather, they trigger a lot of stupid "multimillion dollar" lawsuits from people who think our court system is a candy store. Thus, we get a case worth a couple of thousand (dripping wet) for an cheeseburger filed as a $10 million dollar suit.
