    WILMINGTON, Del. (AP) - A sixth-grade science teacher who was accused of having sex with a 13- year-old student has been sentenced to 10 years in prison.

    Rachel L. Holt, 35, had pleaded guilty to second-degree rape. She sobbed in court Friday as Superior Court Judge Calvin L. Scott gave her the mandatory minimum sentence.

    Prosecutors had wanted Scott to sentence Holt to the maximum of 25 years.

    Holt was initially charged with 28 counts of first-degree rape.

    Police accused her of having sex with the boy that many times during an intense weeklong affair. She was also accused of plying the boy with alcohol and allowing him to drive her car.

    Holt's attorney, John S. Malik, said the sentence was much longer than what teachers convicted in similar cases got. He reviewed 40 such cases and found the average was 18 months to two years.

    In her brief comments to the court, Holt apologized "to everyone who suffered" as a result of her actions, including the victim and his family.

    "I hope you can forgive me," she said. "I know what I did was wrong."

    The victim's uncle, who spoke on behalf of the family, asked for the maximum sentence, saying Holt had tarnished the reputation of teachers and violated his nephew's trust.

    "He had his innocence taken away through betrayal," he said.
    Isn't that a bit harsh? It's not like she killed him or something.

              Minors can't give consent. If they could give consent, they wouldn't be minors and there would be nothing wrong with them getting married and having sex with 40 yearold businessmen.

              Might as well forget any responsibilities (education, feeding, clothing, etc) that parents have to them also.

                  If a 13 yearold can give consent... then what place do parents have? Why should parents be responsible for them? Why should parents provide for them?

                  Now as to why sexual consent is such a big deal, and placed on a similar level as making contracts and the like, it is because it has serious consequences. For one thing it can produce children, it can also give STDs. There are also lines of older people, wanting sex... (we know that 20 yearold women are likely to respond to much older men with money... how much more so a teenager or preteen?) Also, many feel that sex has emotional and other serious consequences. These all are reasons why we protect are young in this fashion, as we protect them in other ways (like providing clothing, food, education, protection from neglect, protection from violence, etc).

                  I know that there are many who feel that there are no emotional issues to sex, or the like. That peoples concern is related to some sort of puritan past. But evidence doesn't show that to be the case.

                  We decide at a time that parents are no longer responsible for their children. This is the time that we remove most protections from young adults, and force them to deal with the older, richer, and more experienced world.

                  In order to aid in that transition, we do allow more responsiblity as one grows older (somewhat dependent on parental chioces).

                  So yeah, a 13 yearold guy can't. That is the basis of legally can't as well. If I thought differently, I would say differently, and try to change the law.

                      Yeah. Should be less if the adult wasn't also in a position of responsibility.

                        A pupil is a very small hole. And then there is the fact that the cornea is in the way - I wouldn't like to imagine how they got around that problem.

                          i wonder how they came up with the number 28. was someone counting? did they ask the boy for an average or something?
