I just checked California's law on conspiracy -- Penal Code § 187. No agreement amounts to a conspiracy unless some act besides the agreement is done within this state.

I'm pretty sure that this is the law across the country. So, just drawing up a list of 300 people & mechanical devices to kill is not a conspiracy.

Laws and reason don't apply much to youth, especially not when it involves a school. Schools have extreme latitude in dealing with students.
