    Well, me, my attorney, and apparently the city attorney think I will.


    I've been going to court to get Eureka's anti-camping law struck down, under the Federal Ninth Circuit's Jones v. City of Los Angeles, which said that it's unconstitutional under the cruel and unusual punishment clause of the constitution, to prohibit sleeping. The court was vague, and didn't specify times or locations. There was court mandated arbitration which the city rejected. There have been other shows of bad faith in the Ninth Circuit's jurisdiction : Los Vegas had a law against feeding anyone who appeared to be homeless. Fresno, CA has a temporary injunction against destroying camping equipment. Even in Los Angeles, where the Jones decision originated, the city refused a court ordered federal mediator's plan, and plans to appeal.

    In Eureka, since the Jones decision, the cops have also destroyed camping equipment, claiming the camp was illegal, although that ordinance is likely to get struck down tommorow. In addition, the police, in a town of 26,000 have killed three times this year, and there are numerous reports of police brutality, which may be used in court.

    The former city attorney decided to prosecute me, he was so disliked by some of the residents, they were filing almost one suit a week aganist him when I was following local politics last winter. (The disfunction of the city morphed into litigation recently. )The new city attorney wanted to settle with an injunction against the city enforcing the law! My attorney passionately advised me not to sign it, which I won't.

        The fear is that the homeless will begin congregating and Lord knows we can't have the homeless clustering, they must constantly be on the move to become someone else's problem...

          They sleep in cars in back of gas stations.
          Make a law against both cars and gas stations.
          Outlaws parks, they might stand around.

          This has lots of possibilities.

            Sorry Sloww, but outlawing homelessness is already on the books in some places. It's like outlawing flatulence: It stinks and won't work anyway.

              I think it's kind of funny, well ironic anyway.
              Arrest a person for having no place to stay, and now they have a place to stay. That'd be ok. 3 hots and a cot.

                  I find this thread rather sad. Wouldn't you help far more people by helping to cure the underlaying problems which cause homelessness (mental illness, drug addiction, alcohol addiction) rather then wasting everyone's time fighting for a "right" for homeless people to "camp" where ever they want?

                              BTW I am hardly a rightwinger but even I find the nineth circuit's ruling to be garbage in that case. The court is claiming that it is cruel and unusual if a city bans loitering are camping on sidewalks or parks and that is simply an unsound ruling. It will get tossed out like so many other 9th circuit reach cases.
