    WASHINGTON - A federal judge upheld the Bush administration's new terrorism law Wednesday, agreeing that Guantanamo Bay detainees do not have the right to challenge their imprisonment in U.S. courts.

    The ruling by U.S. District Judge James Robertson rejects a legal challenge by Salim Ahmed Hamdan, a former driver for
    Osama bin Laden whose case prompted the Supreme Court to strike down the Bush administration's policy on detainees last year.

    Following that ruling, Bush pushed for and got a new law that established military commissions to try enemy combatants and stripped them of the right to seek their freedom in U.S. courts.

    Robertson said Congress clearly intended to keep cases such as Hamdan's out of federal courts and, because of that, he no longer has jurisdiction to hear it.

    The ruling is a legal victory for the Bush administration, which has been fending off criticism of the new law from Democrats and civil libertarians.

    The ruling does not affect the fate of hundred of detainees whose cases are awaiting a ruling by a Washington appeals court, which is reviewing two precedent-setting detainee cases challenging the new law.

    Maybe we should start making the same distinction over here. There are people that all have the same rights under Dutch law and there are Americans...
    Within weeks they'll be re-opening the shipyards
    And notifying the next of kin

      Hopefully SCOTUS believes in habeas corpus more than this authoritarian ****wit. Anyone who the Admin calls an "enemy combatant" has no meaningful right to challenge his or her detention. Horse****

          In canada, because they believe in human rights, you are afforded a great number of protections just by being within Canadian territory.

                My own thoughts on "rights" is that the real concern of the founding fathers was not protecting the "rights" of murderers, rapists and thieves. Rather, they wanted to limit the actions which governments could take: no laws barring free speech; no unreasonable searches & seizures, etc.

                Thus, all "American" civil liberties should apply to all people, whether they be the Bush twins arrested on another DUI or al Qaeda terrorists plainning to blow up an elementary school.

                  My dear fellows. It's not a matter of rounding up all Americans, or Egyptians, or Iranians, or anyone.
                  People of their cultures are in-country, as citizens or not.
                  They're there for a reason. The Court agreed.

                        Yes, American gangsters prefer to hold out in Canada. If the US attempts to extradite them the Canadian government insists on having the identity of witnesses made public in court. This gives the gangs the opportunity to liquidate the witnesses.

                          The Constitution makes no such distinction. The law is very clearly unconstitutional and should have been struck down.
