        Well, if gay porn would have freaked him out...it's not against the law for your BF and yourself to hold a conversation with each other to pass the time while they're searching, is it?           In a rural backwater, it might not be the best idea to discuss your raging homosexuality with people who have guns and can make every shred of evidence you existed disappear.

          Generally, it's a lot easier and much less of a pain in the ass to ascede to power than to fight for your rights. Most of the time, as when I was surrounded by cops cuz I accidentally dressed like an anarchist while a protest was going on nearby, it's such a minor thing, just let them see the kitter liter and go on your way, rather than spend a few days in jail on some BS charge.

              The search was entirely unreasonable. You should not have consented to it, but it's also entirely understandable that you did.

                          Unreasonable search? No. You gave them permission.

                          Probable cause (for pulling you over), this is where its a little fishy. You are probably right in that they wanted to search your car because of all the covered stuff and gave some BS reason to pull you over, but the search was ligitimate. I'm sorry Asher, but it all comes down to you signing the form. Go with what Sloww said. If they ask, say no. The only reason they ask is because they see no outward reason for a search.

                          Bah... I'll right more when I get back from work. I gotta get going.

                              I understand they needed my consent to search.

                              I also understand if I didn't get my consent he'd likely "reconsider" his warning on the "plate issue" and/or follow me and write another absurd ticket, as he knew full well I live FAR away from that part of the province and will absolutely not return to fight it.

                              So, yes, I do understand it is a "legit" search in that I signed the form. What I also understand is it's a bit of a bullying act because you know they're not just going to shrug and let you go and say "have a nice day" after they waste ~15-20 minutes of two officers time and obviously have a suspicion of the contents of your car. I can easily see them finding another excuse of pulling me over, etc.

                                Two issues:

                                1. The pretext stop. Asher has a right to make a complaint about that, if he really believes that there was no valid reason for the officer to stop his vehicle. (assuming there is an authority that would handle such a complaint about a procedural issue)

                                2. While Asher did consent, you could argue that it was not good faith consent because it was granted under the "threat" of a summons. Consent should be a good faith consent for it to be valid. How reasonable Asher's belief that he was under the threat of a summons would be the sticking point.
