  • Ken Starr pulls forged affidavits

Reported in today's Los Angeles Daily Journal:

Ken Starr and his co-counsel David Senior have been forced to withdraw a half dozen affidavits from jurors submitted in support of a clemency hearing for convicted murder Michael Morales. Jurors have reportedly repudiated the affidavits, saying they never spoke to defense counsel and did not sign the documents.

Senior argues the affidavits are genuine but claims there is lack of time to verify this fact before next Tuesday's hearing. Moreover, the affidavits are tangential to defendant's main argument.

Morales was convicted of murdering 17-year-old Terri Winchell as a favor to Morales' cousin. Winchell was dating the cousin's male lover.

Morales' death sentence was imposed for laying in wait. This finding was based upon a jailhouse statement to another prisoner. The basis for the request for clemency is that the jailhouse informant claims that Morales told him in Spanish of the plot to kill Winchell....but Morales doesn't speak Spanish.
