  • Oerdin, see if you can get your hands on the opinions from State of Louisiana, ex Rel. Guste v. M/V Testbank. It's a beautiful example of two well-reasoned legal arguments by well-respected jurists coming down on opposite sides of an issue. By necessity, of course, one of the well-reasoned arguments is tossed out. It's a 5th Circuit case from 1985, if you decide to look for it.

    • Sen. Ben Nelson, D-NE, one of the Gang of 14, says he's impressed by Judge Alito, according to the Houston Chronicle. He says he feels assured that Alito, if confirmed, will not be a judicial activist or take a political agenda to the bench.

      I don't think there'll be too much drama in the Senate after all. When it comes down to it, not enough Senators will see the need for a major battle over this.
