Originally they were charging him with sodomy laws as well which in that state is a life sentence. (Used to be the Death Penalty back in 19th century).

I've been waiting and praying on this ruling for quite some time.

And looks like they were even right at chaeging him with sodomy,
as, contrary to, for example germany, where sodomy just means sexual acts with animals,
within the USA sodomy encompasses all sexual acts which don´t lead to procreation (such as anal or oral sex) regardless of gender/s involved.

Does this mean I get punished more severely if, within the USA, I just get a blowjob from a girl than if i have Sex with her?

That is correct, but at least the US surpeme court in 2003 ruled sodomy laws unconstitutional although Virginia still prosecutes them.

Hell in my state still if you have sex with a woman between two hotel beds its a felony. And Missionary straight sex was the only legal way to go, till the supreme court said differently.

He lived at a group home for the develomentaly disabled, his mental age was definately not 18 but below. Anyway Kansas law (Romeo and Juliet Law) says that it is not as punishable even (now it applies to gay sex too), and that is Kansas of all places.

Since the law specifically applies only in cases where the age gap "is less than 4 years" then presumably at the time of the incident he was not yet 18 and the gap between them was only 3 years. Otherwise his lawyer could not have cited the "Romeo and Juliet" law.

Sex between retarded people is really a can of worms. I've known instances in which women so retarded that they're unable to utter more than one or two intelligible words were allowed to become impregnated by retarded men. The administration of the faciliity that housed them allowed it because they believed that the law prohibited them from interfering. Personally I don't see how sauch instances are anything but legally sanctioned rape sponsored by the government. A person who can't form ideas beyond simple one word utterences can't truly consent to intercourse. It would seem prudent to me to seperate the severely and moderately retarded into same sex housing. OTOH there is some evidence that mildly retarded people are more easily manageable when they live in co-ed facilities.

This is the first case I've heard of retarded people engaging in homosexual acts.
