The couple doesn't have any standing to bring the suit especially over privacy. They lost control over the image when they allowed the paper to publish it. It sure as hell is in Canada, you need to give explicit permission for this -- even if the newspaper wants to publish your picture.

The only part of this sordid affair (other than the idiotic content of the attack they launched on AARP) where they erred AFAIK is that they failed to get permission from the newspaper beforehand.
