At first I thought your suggestion was pretty silly - by having ties we discover who isn't the mafia, but by executing who we suspect is the mafia (if we have 2 top suspects) then we at least have a 50% chance of getting the mafia.
Then I read other people's comments and realised that you meant this method for only the first two rounds. Very sharp thinking (on your part). A tie will guarantee that the mafia isn't offed in the first two rounds, so after that we should have a better idea of who to kill next.
