  • The Apolyton Court: Nominations

    Ceroo would like to formally begin the first process of re-establishing the court- nominations.

    Any nation may nominate any other, UN or not (however to prevent abuse and corruption only one position be 'poly account), and/or nominate themselves.

    If you are nominated and do not wish to stand, then you may withdraw.

    As before:
    "The court will be primarily a mediator, in that if two nations wish to resolve a dispute, but will also act if there has been a transgretion by one nation, when, although it will not have direct power, it will give its recommendation to both nations. No one will be forced to abide by the ruling, unless they have agreed to take part in the mediation at the start."

    If there to be ammendments or additions to this statement, then please bring them up so we can debate.

    Ceroo would like to officially nominate Centralis for their good work in the previous court.

              The People's Federal Republic accepts the nominations, though we are somewhat... hesitant... about support from Al Mastif.

                  Basus excepts the nominations with pride. We would like to thank our nominators for their trust. We would like to nominate Jonchastan, for they have remained neutral in the Franckychan conflict and because they have our trust. We would also have supported Guardinia but they have already involved themselfs to much in the Franckychan conflict.

                    Guardinia agrees that we are currently a party in the conflict and as such can not be considered neutral, at least not in this matter. However, we do still hope that the crisis can be resolved in a peaceful manner.

                      Jonchastan respectfully declines the nomination. While it is the Central Committee's view that a Regional Court is a progressive development for the nations of Apolyton, we are resolute in our belief that lasting, positive change in society cannot be enacted from on high. It would therefore be hypocritical of us to assume a position that gives us powers over the citizens of another nation.

                        If it is not considered unfair to make more than one nomination, then Ceroo would like to nominate Guardinia as well as Centralis.

                        While we respect Basus' opinion, impartiallity to all situations is not possible- even if nominees are not involved with any present-day situations, who's to say they may not find themselves in similar circumstances in the future?
                        It is also believed by Ceroo that Guardinia would be the perfect balance to Auldoninna, should both get elected.

                            Guardinia proudly accepts the nomination. If elected, we will be fully committed to this task whenever we are called upon. However, since we are clearly not neutral in regards to the Frankychanland crisis, we offer to voluntarily abstain from any ruling in this case, provided - of course - that Auldoninna does the same.

                              First of all the people of Basus would like to complement Guardinia on their wise desicion.
                              Second we would like to propose some extra or alternative rules for the court.

                              Basus would like to propose the following rules.

                              1 The court as mediator. All nations within Apolyton can bring a conflict, in wich they are involved or in wich they have a immediate intrest, before the court in a voluntary mediation procedure. All conflicting parties may apoint a advocate. This may be any Apolyton nation as long as it is not a court member. Then both parties choose one court judge. After the negotiations the ruling of the court is binding for both parties. The whole apolyton community will accept this ruling and if one of the conflicting parties chooses to lay it aside the whole Apolyton comunity will raise a embargo against the "rebel" nation. For further action i would like to point out a second function of the court.

                              2 the court as founder of basic and fundamental rights. In this function the court will explain certain words or practices. For example in a mediaton procedure the court could come across the word "atrocity". In it's founding function it could explain the meaning of the word and judge the weight such a practice should be given. If in a other procedure this word would come up the court can point back to the explanation given in a previous case and could use the criteria from this explanation in the new case. The court would create a sort of common law that has no direct implications for the Apolyton Nations but if a conflict would emerge then these rules would create clarity if such a conflict was brought before the court.

                              3 Last but not least parties must have a apeal option. I propose that if on of the conflicting parties thinks that the verdict or ruling is not fair the can turn to the full chamber of judges (5) for a new and final verdict. If parties object to one of the judges then the can expel him from the case.

                              4 Because the court is elected the Apolyton nations can always elect a new court that can undo the common law of the previous court. But the rulings of the previous court in individual cases wil stay intact.
