Ye Olde Constitution of the Hiverian State of China

Preamble

Before the Great Awakening of the People, our state was in disarray and chaos. Without order to provide us life and without philosophy to guide us into the future, our people were on the verge of elimination.

Then Chairman Yang appeared unto us. He taught us his speak, and he told us of what was to come. Before he left us, he had invested into our people the hope of the future people of China and the future of all people.

In accordance with his principles, we the people give unto ourselves this state and we give unto ourselves this constitution to guide our development and safeguard our freedoms. This constitution shall be our supreme law.

Essential Freedoms of the People

Article 1. It is legally and morally recognised that all people have the following rights: Right to non-subversive speech, right to thought, right to opinion, right to media, right to a fair trial, right to education, right to healthcare, right to employment, right to vote. All people have the right to live a life free of undue oppression, tyranny, poverty, and interference.
Article 2. It is recognised that all people have all other non enumerated rights.

Structure of Government

Article 3. The full name of the state is to be the Hiverian State of China.
Article 4. The Hiverian State of China is a state of free association of fraternal peoples.
Article 5. The Hiverian State of China is a state dedicated to the advancement of the condition of all peoples. The national values of the Hiverian State of China shall be Societal Welfare, Autonomy, Socialism, and Science.
Article 6. The Government shall consist of a Legislature, Advisory Board, Judicial Board, Executive Board, and Vanguard Party.

Legislature

Article 7. The Legislature shall be named the National People's Congress.
Article 8. The National People's Congress shall pass all laws and resolutions for the safe development of the Hiverian State of China and shall have the power to conduct foreign affairs and manage domestic affairs.
Article 9. The National People's Congress shall consist of a specified number of people to represent the nation as a whole.
Article 10. These people shall be selected on the basis of universal suffrage in direct elections.
Article 11. Legislation by the National People's Congress shall require assent by the Vanguard Party to enter into legal force.
Article 12. Legislation may be vetoed by the Executive Board or by a 60% vote of the people. Legislation vetoed by the Executive Board may be enacted into law after a 66% vote affirming the legislation.
Article 13. Any referendum that receives a 60% vote by the people shall be considered law.
Article 14. No law may be passed that contravenes the intent of this constitution.
Article 15. The National People's Congress shall be disbanded every month, by vote of the people, or by order of the Vanguard Party.

Advisory Board

Article 16. The Executive will be required to form an Advisory Board.
Article 17. The Advisory Board shall be staffed with technical experts in various fields.
Article 18. The Advisory Board will have the power to declassify information it deems relevant to deliberations or national discussions.
Article 19. The Advisory Board will issue an Advisory to all proposed legislation, and this advisory will be made public.
Article 20. The Advisory Board will also argue the Devil's Advocate and issue a defence of opposing views.
Article 21. Members of the Advisory Board shall serve at the courtesy of the Executive Board and of the Vanguard Party.

Judicial Board

Article 22. The Judicial Board shall be tasked with upholding the Constitution and the Legal Code of the State.
Article 23. The Judicial Board shall be appointed by the Vanguard Party.
Article 24. The Judicial Board shall have powers of arbitration over the interpretation and legality of laws and resolutions.

Executive Board

Article 25. The Executive Board shall be headed by a President.
Article 26. The President shall be tasked with implimenting the laws of the state.
Article 27. The President shall have the power to organise the Advisory Board and any other Departments that the President shall deem fit to organise.
Article 28. The President shall have power of veto over the Legislature, however this veto may be nullified by a 66% vote of the Legislature.
Article 29. The President shall serve for 2 months.
Article 30. The President shall be directly elected through universal suffrage.
Article 31. A 66% vote of the population shall recall the President.

Vanguard Party

Article 32. The Party of Yang shall be deemed the Vanguard Party.
Article 33. Comrade Tassadar shall be deemed the official representative of the Vanguard Party in all matters.
Article 34. The Vanguard Party shall be able to dissolve the Legislature, appoint members to the Judicial Board, approve members to the Advisory Board, and the assent of the Vanguard Party shall be required for all legislation.
Article 35. The Vanguard Party may not be removed or changed in any form by any body.
Article 36. The official representative of the Vanguard Party shall appoint a successor before his death. The official representative shall be considered the Head of State.
Article 37. The Vanguard Party shall also be the means of arbitration for all disputes not within the purview of the Judicial Board.

Other

Article 38. This constitution may not be altered except by way of an 80% vote of the Legislature and the assent of the Vanguard Party.
Article 39. The Executive Board may declare a state of emergency, suspending the Legislature and allowing the Vanguard Party to rule for a period of 1 month.
Article 40. This State of Emergency may be vetoed by the Vanguard Party or by the people via referendum.
Article 41. All organisations, including corporations and political parties, must register with the State.
Article 42. All citizens must register with the State.
Article 43. A citizen may not be stripped of citizenship except by ruling of the the entirety of government.
Article 44. A procedure for citizenship shall be established.
Article 45. The Government shall ensure the continued prosperity and advancement of the State and its people.

Subarticle 1. This constitution shall enter legal force with the assent of the Vanguard Party.
Subarticle 2. The Vanguard Party shall rule until a National People's Congress and an Executive Board is elected.

I, Comrade Tassadar, Official Representative of the Party of Yang, hereby officially give assent of the Vanguard Party to this constitution.

On 29 October, this constitution entered legal force. The Tassadarian power monopoly has now been broken.

Personaly I feel we should wait till we actualy get Communism in game before we go with such a system based on actual Communist history.

Instead we should have a time period apropriate goverment form which we update periodicaly through the course of the game and as our internal affairs may nessesitate.

As of right now we should be looking at having an Emperor and an Imperial court. I've been roleplaying our diplomacy with that Bananas in that direction as well.

Our membership isn't large enough to make frequent formal elections very usefull at this point so I'd say we do one round of Title awarding and call that the "First Dynasty" which will last untill such time as a re-organization is agreed upon and conducted to create subsequent Dynasties. Positions could be as follows.

Emperor - Primary leader and turn player
Chanslor - Backup turnplayer
Royal Concubine - a position for Tassadar to Spam us from
High Priest - for 'divining' information about the other teams
Grand General - Head of the Military, will make plans for Banana war
Chief Diplomate - our diplomate to forgin teams (currently me)
Chief Eunic - ?guarding the Royal Concubine?

Plus other positions to be desided upon as needed.

Do we need officialdom and hierarchy at all? We all know each other (or most of us do) so I don't think we need paperwork or "checks and balances".

Can't we just have a large mess where everythings done by whoevers in the right place at the right time? We've got an idea of our respective strengths/weaknesses and preferences (i.e. game skill, spamminess, activity, murderous intent towards bananas) so can't we just let that guide us?

Sure we don't but if someone is willing to at least discuss it, we can have them for the sake of discussion..

I'd only agree to any titles and positions if they are just for fun. The gameplay should stay informal just like it is now, without any bothersome procedures or without any right to veto or decide something on your own. In other words, like in Sparta. Sure, the members who participated most ended up with a higher rank in the military, but anyone could participate in the discussion, play the turn if necessary etc.
