The rule goes like this(after making lots of observation):
If you attack a non-fast unit:
If your oponent is at 1HP and lowers your HP to 1, you won't disengage.
Else If your oponent is not at 1HP and lowers your HP to 1, and you can move back one tile, you will disengage.
Else, you won't disengage.
If you attack another fast unit:
You can't disengage.
I had elite cavalry disengaging... but, maybe there is a small % that better units(elite) might not disengage... which would be stupid, because, they should know better by now to disengage and retreat when in trouble, lol.
I am a veteran gamer. I know better than to waste time looking at game documentation.
Now Karhgath, I think you may be on to something. I may be confused because my elite cavalry more often would drop the defender to one hp so therefore would be more likely to get caught in this trap.
Interesting undocumented feature if true.

ps. Before I had decided that this problem was related to elite units I thought it was related to attacking from hills/mountains.
