Here's an analogy

Let's say you own a store and someone steals something from it (maybe "unintentionally"). So you run out and catch the guy. The guy says, "I won't give you back your item, but we and the passersby can stand here and bargain about what to do. Maybe you can buy back what I stole." Do you bargain with him? Hell no. You take back what is yours, or you call the police to do it for you.
