Come on. Power to the people! Let the avatars run free!

      Nice avatar IW!
I'm building a wagon! On some other part of the internets, obviously (but not that other site).

So KH... as long as you aren't using it... anybody can.

The artist makes a political statement by withdrawing his work. Picasso and "Guernica" spring to mind...

          Yes....but re-sizing a photo does not a artist make.

              Cropping, resizing and compressing...

You obviously haven't seen the crap that people are allowed to copyright. This is a derivative work of a public-domain work; my rights to the work I did are protected under the law.

So, have you actually copyrighted the kitten?

Sheesh, it's just an avatar. I'd be flattered if someone else started using mine...

Not necessary, IIRC. Preferable to actually get notarised form, but only for proof purposes...

This is true, modifying public-domain then makes the derivative your property. No copyrighting necessary for it to stand up in court.

That's a pretty bamn stupid rule, IMHO.

                              Confused Kitten...

Amazingly stupid thread (and yet I contribute...).

Copyright is a publication issue and an intellectual property issue. What KH says about his actions creating a copyright-able work is true. The laws, while ostensibly about IP are, in fact, designed to prevent economic harm to lawful rights holders. Further, enforcement starts with the IP holder, who must a priori stake his claim (the circle-C).

But here, there is no commerce and no intent of commerce, thus no real harm. In addition, this site/forum is a public place on which we dwell at the whim of the owners. KH chose to post (publish) his avatar on this public board -- on the Web!! -- without staking any claim to the "art" involved in its production.

There's moral right and legal right. You're batting .500, KH. Enjoy the moral high ground, but with no economic claim, no provable damages, and a faulty approach to protecting your intellectual property, you have no legal claim (especially to a public domain "version" that can be substantially -- and legally --duplicated.

BTW, that line equating graphic sizing and data compression to art is just too precious. All that did was cede squatter's rights...

OK, bored now. Y'all have fun.

BTW, per KH, that also should mean that RAH owns copyright to several of the Muppet avatars!
