Byzantine diplomats have publicly made their claim to the Black Sea area for centuries including the clear warning that anyone attempting to settle the region would be forcefully removed. Everyone can plainly see that our public warnings were not "after the fact".
The Holy Romans did not dispute this public claim or negotiate instead they merely sent warriors and workers to build roads to deceptively attempt to claim the Byzantine lands.
