      • The court shouldn't have said the ACA was constitutional in the first place, the power to tax (Roberts' rationale) is not the power to spend... The Constitution is a grant of powers and no where does it say Congress can do what it wants. Why bother with a Constitution if Congress has the power to tax and spend on whatever they like?

            • Berz didn't speak against the power to tax. Once one is fine with that, you should be fine with the power to spend - I mean it's just using what you obtained after all.

                  Thats right, the power to tax is not a power to spend... spending is limited to those enumerated powers mentioned in the Constitution. For example, Congress can run a postal service and build forts etc and pay for them with taxes...
