In the escalating battle between the administration and the judiciary, a federal appeals court apparently is calling the president's bluff -- ordering the Justice Department to answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law, according to a lawyer who was in the courtroom.
The order, by a three-judge panel of the U.S. Court of Appeals for the 5th Circuit, appears to be in direct response to the president's comments yesterday about the Supreme Court's review of the health care law. Mr. Obama all but threw down the gauntlet with the justices, saying he was "confident" the Court would not "take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress."
Overturning a law of course would not be unprecedented -- since the Supreme Court since 1803 has asserted the power to strike down laws it interprets as unconstitutional. The three-judge appellate court appears to be asking the administration to admit that basic premise -- despite the president's remarks that implied the contrary.

For those who aspire to live in a high cost, high tax, big government place, our nation and the world offers plenty of options. Vermont, Canada and Venezuela all offer you the opportunity to live in the socialist, big government paradise you long for. –Senator Rubio

When people are asked about Obamacare, most are negative. When people are asked about individual sections of the bill, the response is extremely favourable. Single payer is also a much more attractive proposition to this crappy bill. Ergo..

I'm a bit curious - how many without insurance are against this law ?With or without religion, you would have good people doing good things and evil people doing evil things. But for good people to do evil things, that takes religion.

He didn't say it was a wise decision.
I know lots of young people that think they will live forever. Health concerns can be rather abstract at that age."I have never killed a man, but I have read many obituaries with great pleasure." - Clarence Darrow

It's one of the areas where my libertarianism conflicts with reality. I have a problem with the State protecting us from ourselves and in general I think people should be free to make decisions for themselves (even bad ones) but then when you look around you realise how stupid the "average" person really is and how widespread the bad decisions would be.
When it comes to healthcare, I see an overall benefit to having a healthy population (productivity, disease control, etc.) and come down on the side of mandated universal coverage."I have never killed a man, but I have read many obituaries with great pleasure." - Clarence Darrow

It's not being forced on them for their own good. It's being forced on them for everyone's own good. There's an obvious difference between health insurance and broccoli.“As a lifelong member of the Columbia Business School community, I adhere to the principles of truth, integrity, and respect.
