    Indigenous woman yells 'I hate white people' before punching white woman, but it's not a hate crime judge rules

    A Calgary indigenous woman who knocked out a Caucasian woman’s tooth while yelling “I hate white people,” didn’t commit a racially motivated crime, a judge says.

    Provincial court Judge Harry Van Harten, in a written decision, said Tamara Crowchief’s motivation for striking Lydia White was not related to racial bias.

    Crown prosecutor Karuna Ramakrishnan, who had sought a sentence of 12 to 15 months, argued Crowchief’s unprovoked attack last Nov. 1, amounted to a hate crime.

    But Van Harten agreed with defence counsel Adriano Iovinelli that there was insufficient evidence to establish Crowchief attacked White because of the colour of her skin.

    Van Harten said unlike offenders in several cases cited by Ramakrishnan, there was no suggestion Crowchief was associated with any group that promoted hatred toward a specific race.

    “The offender said, ‘I hate white people’ and threw a punch,” Van Harten said in his ruling.

    “There is no evidence either way about what the offender meant or whether . . . she holds or promotes an ideology which would explain why this assault was aimed at this victim,” he said.

    “I am not satisfied beyond a reasonable doubt that this offence was, even in part, motivated by racial bias.”

    White was outside Jaimieson’s pub on 17th Avenue S.W., with a friend when an acquaintance of Crowchief’s approached and asked for, and was given, a cigarette.

    As White and her male friend spoke to that woman, Crowchief approached and, without warning, yelled “I hate white people” and punched her in the face, knocking out a tooth.

    Crowchief and the woman then walked away, but White and her friend followed and called police, who arrived a short time later and arrested the offender.

    During her arrest, Crowchief told police “the white man was out to get her.”

    In her victim-impact statement, White said she still doesn’t comprehend what motivated her assailant.

    “I still get angry when I think about it,” she said.

    “I don’t understand why this woman did this. I never did anything to her. Never even spoke to her,” she said.

    Van Harten agreed with Iovinelli the more than six months Crowchief had spent behind bars, which he equated to a 9 1/2-month sentence, was sufficient jail time for Crowchief.

    He placed the city woman on 12 months probation and ordered her to get psychological and psychiatric counselling, as well as counselling for substance abuse.

    She must also abstain from consuming intoxicating substances and is prohibited from going to any business whose principal sale is alcohol.

    Maybe the assailant was actually saying "I hate White people" instead of "I hate white people"

      There might even have been a hidden comma. "I hate White, people." Then she's simply announcing to the crowd that she doesn't like the victim, rather than showing bias against a particular family/race.

              I think he adressed Lori directly, so if he (Lori) is not a member of the Nation of Islam the woman in the article is innocent.

                Given the woman in question has a previous conviction for an unprovoked punching of a woman, whilst shouting she was a rat, I think it's clearly justifiable to say she is just bat**** crazy*, and not unequivocally committing a racially motivated attack.

                It may have been, but the explanation of a newspaper is not enough to give a clear picture of reasoning.

                * Especially given the article says: "He placed the city woman on 12 months probation and ordered her to get psychological and psychiatric counselling, as well as counselling for substance abuse."

                  I was channel surfing the other night and saw a show called dating naked or something like that and just had to check it out.

                  There was some clown and on a double naked date he was demonstrating the original Mangina (standing with genitals tucked behind his legs.) and even called it that.
                  Both women there were extremely offended by the term. I could only laugh. It was effectively the end of his date.

                        Given present laws in Canada and the current government in Alberta, I'm surprised she was charged at all.

                          Yeah, the title is definitely an attention grabber. But I can't believe anyone would be interested for more than a few minutes.
                          There is also a survivor naked show too. I guess anything with naked in the title will generate a few points of rating.
                          Maybe if we weren't such a prudish country, they wouldn't. I will admit that I watched the survivor naked show for a few minutes longer because it did seem to be an additional hardship. But once for each was enough.

                            I watched the naked survivor show with my brother a few times because he's a big fan - it was pretty boring because it turns out that naked people are prime mosquito bait in the Amazon, so after three nights of no sleep the two contestants dropped out

                              Yeah, the one I watched the girl dropped out due to exposure and the man spent the entire show fighting the mosquitoes.
                              I wonder what they offer the people to make them agree to do this. It would take one hell of a lot of money.
