Teen girls charged with child pornography after photographins themselves nude

    The law is the law, and what the kids did was illegal. And yes, that's crazy. On the other hand, if the state were to make exceptions for self-produced child porn (although, teens are not children), it would be exploited by peddlers of teen porn.

    Also, the principal did not illegally go through the phones. As previously mentioned, schools have parental rights over children, and kids in school have no 4th Amendment protections.

    What's even crazier is that the age of consent in Pennsylvania is 16, but 16 and 17 year-olds cannot take nude pictures of themselves. Granted, the girls in this case were under the age of consent, but what I wrote points to the arbitrary and haphazard state of the law.

    The kids should go for a jury trial and try and have the jury nullify.

        Very well put. By allowing an exemption in the law for self-produced child porn, you open up unintended consequences. Believe me, people would use that loophole.

          Check this out, people who took pictures of themselves as teens, and held on to them as adults have been prosecuted for possession of child porn.

            Well, couldn't we take care of these people somehow without punishing the person who is actually in these photos and as such constitutes the actual 'victim' here? It's not like kids have to deal with statutory rape charges after having sex with adults either.

              Plenty of absurd situations to go around. Back in the day, a tabloid here with a regular 'nude girl of the day' feature would once in a while show somebody aged 17. Thousands of people picked up those newspapers at the airport and brought them to places like the US where they could technically be charged with bringing child porn into the country, even though all of these girls were very much biological adults, not at all catering to any kiddie porn audience.

                this thread is useless without pics. LOL that was bad, I apoligize. People like me is why this should be illegal.

                The law is the law. And in this case, I feel the law should be upheld. If anything, to teach these kids cell phones are serious, and they should be careful with them. I recently had someone track me down due to something I put on the internet. Sometimes you aren't as anonymous as you'd like to be. So people really shouldn't be sharing these things.

                      In the US, even if the kids plead out to a lesser charge, they will be branded as sex offenders for the rest of their lives. This will limit the kind of work they can do, the places they may live, and the kinds of charities and political activities they can engage in. If any othe legal issues cross their path, even if they are only witnesses, the reporting both in police records and in the press will use the words "known sex offender" will precede their names in any testimony or statements they may give.

                      Children taking and exchanging pictures should not receive the label of a child sex offender, which does in fact happen regularly in this country. If any of them ever get caught in a divorce or custody fight, the judge will consider what they are now labelled as, and award the max to the other side. Very Bad! Due to a nosy principal.

                        I'm going to have to ask for proof any of these convictions ever stuck. I've heard several times of incidences of teens getting charged with porn for pictures of themselves (or in this case sent to them), but have never heard of any convictions. Esp. with them being branded as a sex offenders. So feel free to provide any links to actual convictions.

                            i think that people should get a card blanche for using pictures of themselves/

                            if someone's self teen pics are being sold, you can bring charges against the party making a purchase or what ever.

                            but who is really being hurt in this scenario? is the seller hurting himself in the past? Does he retroactively causes himself psychological issues?

                            kiddie porn is illegal because kids should not be abused. if no child is abused, then the law should be applied with extreme caution.

                              laws should be there to serve a purpose - protecting people from harm. specifically actual kids from abuse.

                              upholding the law for the sake of upholding the law, when it is clear there is no justification for that, is silly. the law has a purpose and everything should be judged in it's light.

                              a 13 y/o taking nude pics of herself and posting them online would be incredibly stupid, as she would suffer much consequence socially and psychologically.

                              Making it a crime, and charging the 13 y/o for being stupid, is just plain dumb and helps no one.

                                Already is and these kids are being charged with trading as well (the "dissemination" part).
